Official Rules

1. ELIGIBILITY. NO PURCHASE NECESSARY. VOID WHERE PROHIBITED.

The SmartMarketing $100 Visa Gift Card Giveaway (the "Giveaway") is open to residents with mailing addresses within the 50 United States and District of Columbia, who are 18 years of age or older as of time of entry, except the employees and their immediate families of SmartMarketing ("Sponsor"), and its respective affiliates, subsidiaries, parent and related companies, and agencies.

2. HOW TO ENTER

Beginning on February 10, 2020, you may enter on-line by following the instructions in these Official Rules. No telephone or mail entries will be accepted.

Limit one (1) entry per person.

Entries will be accepted after Thursday, February 10, 2020 at 10:00AM (EDST) and must be received no later than Monday, March 9, 2020 at 11:59PM (EDST).

Entries that are lost, late, illegible, incomplete, misdirected or incompletely received, including by reason of technical malfunction, congestion or incompatibility, will not be eligible. Sponsor, its affiliates, subsidiaries, parent corporations, and its respective officers, directors, shareholders, employees and agents, are not responsible for any incorrect or inaccurate entry information, theft, tampering, destruction, or unauthorized access to, or alteration of entries; printing or other errors. Illegible, incomplete and duplicate entries will be disqualified. All entries become the property of the Sponsor and will not be returned. By entering the Giveaway, entrant affirms that he or she has read and agrees to abide by the Official Rules and the decisions of the judges. The laws of the United States apply to and govern this Giveaway and any claims must be raised and resolved in the United States.

3. PRIZES

Total of one (1) Prize will be awarded to one (1) winner in this Sweepstakes.

Total Approximate Retail Value of Prize is $100.00. Prize consists of 1 $100 Visa gift card. Odds of winning the Prize depend on the number of eligible, verified entries received in this Sweepstakes.

The Prize will be awarded "as is" with no warranty or guarantee, either express or implied. All prize details are at Sponsor's sole discretion and may not be substituted, sold, assigned or transferred, or redeemed for cash; however, Sponsor reserves the right, at its sole discretion, to substitute the Prize with one of comparable value. Once issued, Prize will not be replaced if lost or stolen. Winner is solely responsible for all applicable local, state and/or federal taxes or other costs and expenses associated with prize acceptance and use.

The giveaway period begins at 10:00am (EDST) on Thursday, February 10, 2020 and ends at 11:59PM (EDST) on Monday, March 9, 2020.

One (1) winner will be randomly selected from among all eligible entries received. The random drawing will be conducted by judges selected by Sponsor, whose decisions are final in all matters relating to this Giveaway.

The odds of winning depend on the number of eligible entries received. No substitution or transfer of prizes will be allowed. If necessary due to unavailability of any of the prizes, a prize of equal or greater value will be awarded at the discretion of the Sponsor.

4. WINNER NOTIFICATION AND PRIZE DELIVERY

Winners will be notified by e-mail. A winner must comply with all instructions in the prize notification and winner's complete response must be received by Sponsor within 14 days of the date on the prize notification. If not, prize will be forfeited and an alternate winner selected. Winner may be asked to complete a release. Winner shall be solely responsible for paying and shall be solely liable for any applicable federal, state or other taxes.

Sponsor shall not be responsible for and expressly excludes any and all liability associated with locating winner in the event that winner provides incorrect or outdated prize mailing address.

5. RELEASE

Upon delivery of any prize to winner, Sponsor will be deemed to have awarded the prize to the winner with winner assuming full ownership and responsibility for the prize. By entering and/or accepting a prize, winner releases and agrees to hold harmless Sponsor, their parent, affiliate and subsidiary companies, directors, officers, employees, representatives and agents from any and all liability for any injuries, loss or damage of any kind, including death, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a prize or participation in this Giveaway. Normal product warranty applies as stated in packaging. Acceptance of prize constitutes consent to use winner's name and likeness for editorial, advertising and publicity purposes, without further compensation, except where prohibited. Winner's name and likeness may be posted on https://smartmarketingnow.com and on https://www.facebook.com/SmartMarketingNow/.

6. GENERAL

Sponsor reserves the right to modify, suspend or terminate any entry or this Giveaway in the event that it becomes infected by a computer virus or is otherwise technically impaired. In the event of early termination, a random drawing will be held from among all eligible entries received at the time of termination.

Sponsor may prohibit an entrant from participating in the Giveaway or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Giveaway by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants, Sponsor, or Giveaway Entities. If for any reason this Giveaway is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the promotion, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Giveaway.

This Giveaway is governed by the laws of the United States and the state of Florida with venue in Naples, Florida. By entering, you agree to be bound by these rules and you give your express permission to be contacted by Sponsor by e-mail and/or mail.
